Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. Participating in this site indicates that you accept the Terms and Conditions. If you disagree with any part of the terms then you may not access the Service.

About us

 CampaignLabs is one of the most advanced SMS Campaign sending platforms in       India. It has numerous capabilities like sending Bulk SMS, Campaign Management, Advanced Scheduling, Super Segmentation, Data reporting and Analysis, and multi-offer suppression.

Authentic User Information

User details provided by the user should be true and authenic to his/her knowledge.All information thus provided by the User will be kept confidential for official use only. The User will be held solely liable for any false details provided, CampaignLab will not be held responsible for any incorrect information shown on the platform.

Subscriptions

Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring monthly/yearly basis as registered by you.

Intellectual Property Rights

CampaignLabs owns all the title, ownership rights,  and intellectual property rights in and to the Content and Services. All the rights are reserved, except as expressly stated herein. The Content and Services are protected by copyright laws and other laws. You agree that these terms of services do not grant you any Intellectual Property Rights. We reserve all rights. 

User Warranties and User Obligation

The User agrees to comply with all applicable laws, regulations, Network Operator requirements or applicable codes of conduct which may be applicable in their jurisdiction and the jurisdiction of all persons to whom they cause messages to be delivered.The User shall not engage in any fraudulent act and shall not send unlawful, abusive, harrassing, messages to any end user. The User should understand that all information, data, text, messages or other materials, whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not CampaignLabs, is responsible for the Content that the User upload, post, email, transmit or otherwise make available via the Service. Under no circumstances, CampaignLabs will be liable in any way for the content of messages sent.

User should be aged 18 or above 

The user certifies that he/she has a legal age of 18 years or above or the corresponding age for working in their respective state or country.

Limitation of Liabilities, Warranties, and Indementies

The User hereby indemnify and hold CampaignLabs harmless against any and all damages, liabilities, risks that may follow from violation of these terms and conditions. User further indemnify and hold CampaignLabs harmless against any claims, actions or damages from any party as a result of the fraudulent or unauthorised use or loss thereof by any third party.

CampaignLabs does not represent or warranties regarding the quality of the services,  it does not warranties that the services will be error free, uninterrupted, or free from any defects or errorsor that the results that may be obtained from the use of the service will be accurate or reliable.

It is understood that User will indemnify and hold CampaignLabs harmless from any and all claims, demands, actions, or causes of action made or asserted against CampaignLabst, including reasonable court costs and attorney fees. CampaignLabs shall not be deemed an insurer of the User with concerning  any transaction between them.

Termination

Where a User breaches any of these terms and conditions, without prejudice to any of its legal rights, CampaignLabs shall be entitled to, to cancel its agreement with the User, to suspend or terminate the provision of services to the User, to suspend, disable or terminate the User’s account’s. CampaignLabs reserves the right in it’s sole discretion to suspend or terminate such accounts.

Where a User account is suspended or terminated due to any breach of these terms and conditions, CampaignLabs reserves the right to also suspend or terminate all other accounts registered by, or on behalf of such User, as well as suspend or terminate any account registered by any other person or persons whom CampaignLabs, in its sole and unfettered discretion, believes is affiliated with the User concerned.

Force Majeure

CampaignLabs shall not have any liability for any delay or intereption caused by acts of god or other reasons that are beyond the reasonable control. An event beyond the reasonable control is a force majeure event.

Modifications

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is a material we will try to provide at least___days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Applicable Law

The agreement and all rights, duties, and obligation arising hereunder shall be governed in accordance with the laws of India.

Dispute Resolution

This Privacy Policy shall be governed by and construed under the laws of India. All disputes concerning these Terms will be referred to Arbitration under the Arbitration and Conciliation Act, 1996. The Place of Arbitration shall be Bhopal, (M.P)
